REGULATIONS OF THE ONLINE STORE OF THE SILESIAN UNIVERSITY OF TECHNOLOGY

General information

The regulations of the Silesian University of Technology online store specify detailed rules for making purchases in the online store https://esklep.polsl.plBefore making a purchase, customers are asked to read its content.

The owner of the online store is the Silesian University of Technology with its registered office at Akademicka 2A, 44-100 Gliwice, operating pursuant to the Act of July 20, 2018 - Law on Higher Education and Science

Definitions:

  • Order Processing Time – the time during which the order is completed and then handed over to the carrier to deliver the Goods to the address indicated by the Customer; Order Processing Time does not include delivery time (the time between the Seller handing over the Goods to the carrier and handing them over to the Customer);
  • Working days - days of the week from Monday to Friday (excluding public holidays);
  • Customer - this means a natural person with full legal capacity, as well as a legal person and an organizational unit without legal personality, which is granted legal capacity by special provisions, and which places an Order. Organizational units of SUT cannot be clients. 
  • Account – a service provided electronically; a modifiable element of the Online Store dedicated to the Customer, created after the Customer registers;
  • Shopping cart – a service provided electronically; a form constituting an integral part of the Store's purchasing system, in which the Customer confirms the subject and conditions of the Order, i.e. type and quantity of Goods, delivery or invoicing data, method of payment;
  • Regulations - these regulations of the Online Store;
  • Registration – a service provided electronically; the procedure carried out by the Customer in the manner indicated in the Regulations in order to create an Account and possibly complete the Order and use specific functions of the Online Store;
  • Online store (store) – online service available at https://esklep.polsl.pl . using which the Customer may, in particular, place an Order for available Goods; https://esklep.polsl.pl. z wykorzystaniem, którego Klient może w szczególności złożyć Zamówienie na dostępne Towary;

  • Goods - a product indicated in the Online Store, which may be the subject of a Sales Agreement, the essential properties of each Good are made available on the Store's subpage assigned to it; the image of the Goods presented on the Online Store's website is a visualization of its actual appearance and is for information purposes only;
  • Sales contract - a contract for the sale of Goods within the meaning of the Act of April 23, 1964 - Civil Code, concluded in accordance with the provisions of the Regulations between the Seller and the Customer, via the Store;
  • Order - the Customer's declaration of will leading directly to the conclusion of the Sales Agreement, specifying its essential terms, made using the Cart.

In order to use the Online Store and complete the Order, the following minimum technical requirements must be met: a device with access to the Internet, an installed and updated version of the Internet Explorer, Chrome, FireFox, Opera web browser, an active e-mail account.

The use of the online store depends on the acceptance of cookies and the privacy policy. Failure to accept cookies may result in improper functioning of the store.

The owner will make every effort to ensure that the online store operates uninterrupted. There may be interruptions in the operation of the store, in particular to update data, repair the system or perform other maintenance works, about which the seller will inform on the store's website.

The goods available in the online store are brand new and legally introduced to the Polish market and are free from physical or legal defects.

Placing and fulfilling orders

  1. Orders can be placed electronically through the Store's sales system, 24 hours a day, 7 days a week throughout the year, provided that their execution takes place on Business Days from 8.00 to 14.00.
  2. Purchases via the online store can be made by natural persons, legal persons and organizational units without legal personality. Organizational units of the Silesian University of Technology cannot make purchases via the online store.
  3. Ordering goods is possible only after accepting the Regulations. From the moment of accepting the Regulations, the Customer is bound by its content.
  4. To make a purchase in the e-shop, you must:
    add selected goods to the cart
    complete the order form specifying the delivery method (shipping via In Post courier company or personal collection), delivery address and invoice details, which can be issued on request client.
    choose the payment method and form of payment;
    approve the order form.
  5. The order is effective if the Customer correctly completes the order form and provides correct contact details, including the correct shipping address. The Seller will contact the Customer if the data is incomplete.
  6. The seller's approval of the completed form results in the conclusion of a distance contract and acceptance of the order, about which the customer is informed to the e-mail address provided in the order. Order fulfilment begins with receipt of payment for the order through the iMoje payment system.
  7. Each order comes with a proof of purchase. At the customer's request, an invoice may be issued. The customer is obliged to inform the Silesian University of Technology about the need to issue an invoice and provide invoice data.
  8. Shipping costs of PLN 10 zlotych are added to each order.
  9. In the case of mail delivery, the Customer is obliged to check the condition of the shipment in the presence of the carrier. If the shipment is missing or damaged, the carrier is obliged to specify in a report the condition of the shipment and the circumstances of the damage. The carrier should also do this at the customer's request. The risk of accidental loss or damage to the goods passes to the Customer upon delivery of the shipment.
  10. A sales contract may be concluded by an adult, but by minors only with the knowledge and full supervision of a legal guardian.
  11. Goods ordered in the online store are delivered only within Poland.


Payments

  1. Payment for the ordered goods is made only via online payment.
  2. The order will be shipped within a maximum of 7 business days from the moment of positive authorization of the transaction. Working days should be understood as days from Monday to Friday, excluding Saturdays and public holidays. Orders will be processed between 8:00 a.m. and 2:00 p.m.

Personal data

  1. Personal data (name, surname, street, building and apartment number, postal code, city, country, e-mail) provided by the Customer in the online store of the Silesian University of Technology are processed by the Silesian University of Technology with its registered office address: 2A, Akademicka Street, 44 -100 Gliwice. The Silesian University of Technology is the controller of this data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) .
  2. The data provided by the Customer is processed in order to provide services related to maintaining and servicing the account and fulfilling orders in the online store. The legal basis for processing is the necessity of processing to perform the contract (Article 6(1)(b) of the GDPR).
  3. Providing personal data is voluntary, but necessary to make a purchase in the online store of the Silesian University of Technology and to provide services electronically as part of the operation of the online store of the Silesian University of Technology.

  5. The customer's personal data is used only to complete the order. The Silesian University of Technology does not share data with other entities. By providing personal data, the customer declares that the data provided by them is their data.

Withdrawal from the contract, return of goods, exchange.

  1. Customer: natural persons making ordinary purchases, entrepreneurs making purchases unrelated to their business activity, and natural persons running a sole proprietorship have the right to withdraw from the sales contract without giving any reason within 14 days from the date of receipt of the Goods, on the terms set out in the Act of May 30, 2014 on consumer rights (Journal of Laws, item 827, as amended). Together with the Goods, the Seller will send the Customer instructions on the possibility of withdrawing from the contract. The instruction constitutes Appendix No. 2 to the Regulations.
    This is only possible if the purchased goods:
    a) are in the same condition in which they were delivered to the Consumer;

    order is complete;
    goods have not been used or copied;
    how no signs of use;
    are in intact packaging.

  2. In order to withdraw from the contract, the Customer should send:
    a completed "Declaration of withdrawal from a distance contract" constituting Annex 1 to the Regulations;
    original receipt or invoice for the purchased goods;
    the goods to which the withdrawal from the contract applies.
  3. The store will return the paid goods within 10 business days by bank transfer to the account indicated by the Customer. The seller does not accept cash on delivery shipments.
  4. If it is necessary to refund funds for a transaction made by the Customer with a payment card, the Seller will make the refund to the bank account assigned to the Customer's payment card.
  5. The customer can only cancel the order by e-mail: esklep@polsl.pl . A paid order that has been sent to the Customer is not subject to cancellation. esklep@polsl.pl Anulowaniu nie podlega zamówienie opłacone, które zostało wysłane do Klienta.
  6. The customer may exchange the ordered goods for a different size, style, colour or another product, taking into account any price difference, provided the goods are available. This is only possible if the goods to be exchanged:
    are in the same condition in which they were delivered to the Customer;

    order is complete;
    goods were not used;
    how no signs of use;
    are in intact packaging.

  7. In order to exchange the goods for another product, the Customer should send by registered mail:
    the completed "Exchange Form" constituting Annex 2 to the Regulations;

    original receipt or invoice for the purchased goods;
    the goods to be exchanged.

  8. In the event of an exchange of goods, the Customer is obliged to bear the cost of re-shipping the goods to the Customer in accordance with the selected delivery option and any difference in the price of the goods. The exchange will be made after the payment has been credited to the seller's account.

Complaints

  1. If, after receiving the goods, the Customer finds technical defects in the purchased goods, he or she should return them as part of a complaint.
  2. You can complain about purchased goods within 2 years from the date of sale, but no later than 2 months from the moment the defect subject to complaint is discovered.
  3. In order to complain about the goods, the Customer should send by registered mail:
    a completed "Complaint Form" constituting Annex 3 to the Regulations;

    a copy of the receipt or invoice for the purchased goods;
    the goods to which the complaint relates.

  4. The complaint will be considered by the seller within 14 calendar days from the date of receipt of the complaint form and will inform about the result of the procedure via e-mail.
  5. The cost of sending the complained goods is covered by the Seller. The cost of delivering the goods up to the cheapest method of delivery to the Consumer is refundable. The refund will be made after receipt of the shipment and positive consideration of the complaint, no later than within 10 business days from the date of consideration of the complaint. The damaged product will be replaced with another one of full value, and if this is impossible (e.g. due to the stock being exhausted), the equivalent of the price of the purchased product will be refunded to the Consumer.

Final provisions

  1. The prices of goods are given in PLN and are gross prices. The price does not include delivery costs. The prices become binding when the order is placed. The Silesian University of Technology reserves the right to change the prices of goods included in the offer, introduce new goods and modify existing ones, and conduct and cancel promotional campaigns.
  2. The photographs of goods available at https://esklep.polsl.pl are intended to show examples of the appearance of the goods, which in reality may differ slightly from the photographs posted in the store.
  3. The Silesian University of Technology reserves the right to change the Regulations.
  4. In matters not regulated by the Regulations, the provisions of the Civil Code shall apply.
